General Terms and Conditions (Terms of Service)

1. Scope and Provider

These General Terms and Conditions (hereinafter "Terms") govern all contracts regarding the provision and use of the web-based software platform MedalMaker (https://medalmaker.app), the associated mobile applications (iOS/Android), API endpoints, and smartwatch companions (Wear OS).

2. Contract Structure: B2B Organizations & End Users

MedalMaker is primarily tailored for professional sports academies, federations, and sports clubs (hereinafter "B2B Customers" or "Organizations"), as well as authorized end users (coaches, athletes, physiotherapists, and parents/guardians):

B2B Organization Contract: By registering an organization or booking a plan, a B2B Software-as-a-Service contract is concluded. Supplementing these Terms, our Data Processing Agreement (DPA under Art. 28 GDPR) applies mandatorily to the processing of athlete data.
End User Agreement: Individuals creating a personal account or joining an organization accept these Terms as binding terms of use.

3. Platform Features & Scope of Services

MedalMaker is an advanced Athlete Management System (AMS) and Periodization Planner for individual and high-performance sports. Key features include:

31-day Excel-like periodization calendar and swimlane scheduling.
Dual-career planning (coordinating training, competitions, camps, and academic exams).
Daily wellness and recovery monitoring (Readiness scores, fatigue, stress, soreness).
Scientific training load management (ATL, CTL, Acute:Chronic Workload Ratio / ACWR).
Motor fitness testing batteries (e.g. FMS diagnostics, jump/sprint rankings).
Injury tracking, 2D/3D body pain mapping, and return-to-play workflows.
Gym & strength workout plans with 1RM tracking and video form review.
Wearable sensor integration (Garmin, Whoop, Polar, Apple Health, Google Health Connect) and Wear OS companion.

4. Important Medical Disclaimer (Not a Medical Device)

Mandatory Legal Notice:

MedalMaker is a sports training management and periodization planning tool and explicitly NOT a medical device pursuant to Regulation (EU) 2017/745 (MDR).

All indicators, ACWR load values, readiness scores, menstrual cycle suggestions, and heart rate zones are mathematical and sports science models and do not constitute medical diagnosis, treatment advice, or therapy.
The platform is not a substitute for professional medical assessment by qualified physicians or physiotherapists.
Training decisions and return-to-play approvals are made solely at the discretion and responsibility of the user, coaches, and medical supervisors.

5. Registration, Minimum Age & Minor Protection

Full and accurate registration details are required.
Minimum Age: The minimum age for independent registration is 16 years (Art. 8 GDPR).
Athletes Under 16: Athletes under 16 years of age may only participate with verified parental or legal guardian consent.
Warranty of the Organization (B2B): When creating profiles for minor athletes, the organization warrants that written or electronic consent of legal guardians has been obtained prior to entering health data (Art. 9 GDPR).

6. Subscription Plans and Payment Terms

MedalMaker is offered under several subscription tiers designed for sports organizations:

Club Bronze: €0/month — Small academies & micro-teams (up to 5 athletes, 1 coach, periodization calendar, daily wellness & ACWR monitoring, basic fitness testing, GDPR export).
Academy Silver: €199/month or €1,990/year billed annually — Growing performance academies & clubs (unlimited athletes & squads, 1 training facility, up to 10 staff, S&C gym suite w/ 1RM & RPE, video review hub, 2D/3D injury tracking, wearable sync, dual-career exam planner & parent portal).
Championship Gold: €349/month or €3,490/year billed annually — Regional associations & sports federations (includes 3 regional performance centers, unlimited coaches/staff & athletes, central talent radar & ACWR heatmap, tournament matrix planner, custom branding, public REST API, dedicated account manager).
Regional Center Add-On: +€79/month or +€790/year per additional training center (Stützpunkt) integrated into Championship Gold.
Platinum Enterprise: Custom annual quote — For national Olympic governing bodies and federations with 15+ training centers or >250 squad athletes (dedicated PostgreSQL/VPC instance, SAML 2.0 / AD Single Sign-On, custom DPA/AVV legal review, 99.9% SLA with 24/7 on-call).

Payments are processed securely via Stripe or via direct B2B invoicing/SEPA transfer for Enterprise contracts. All prices are net plus statutory VAT where applicable.

7. Governing Law and Jurisdiction

These Terms shall be governed exclusively by the laws of the Federal Republic of Germany. For contracts with commercial entities, public law entities, or special funds under public law, the place of jurisdiction for all disputes shall be Munich, Germany.
